Terms of Service

These Terms govern Castify's influencer-marketing marketplace, collaboration workspace, and social connections. They define Castify's role, the responsibilities between brands and creators, and the mandatory restrictions that apply to TikTok, Meta, and YouTube data.
1. Agreement and Castify's role
Creating an account requires explicit acceptance of the current Terms of Service and acknowledgement of the current Privacy Policy. Castify records the accepted version, document-manifest hash, time, locale, source, IP address, and user agent for audit purposes.
Castify provides discovery, campaign, booking, communication, content-review, payment-evidence, trust, and reporting tools. Castify is a technology marketplace, not the employer, employee, agent, advertising agency, or legal representative of either participant unless a separate written agreement says otherwise.
A campaign, package, booking, brief, or accepted proposal may create a direct commercial agreement between a brand and creator. Each party is responsible for reviewing the scope, deliverables, timeline, price, usage rights, and applicable taxes before accepting.
2. Eligibility and accounts
You must be at least 18, or otherwise legally capable of entering the commercial arrangements you make through Castify. If you act for an organization, you confirm that you have authority to bind it.
Provide accurate, current information; maintain one appropriate role per account; protect passwords, email access, and devices; and notify Castify promptly of suspected compromise. You are responsible for authorized activity under your account.
Email verification, identity, business, bank, or social-profile checks may be required before high-risk features are enabled. A verification badge is a platform signal based on available evidence, not a guarantee of identity, solvency, performance, audience authenticity, or legal compliance.
3. Brand and creator responsibilities
Brands must publish truthful campaign requirements, disclose material conditions and usage rights, fund agreed payments, provide timely feedback, and avoid discriminatory, deceptive, unsafe, or unlawful briefs.
Creators must present truthful profiles and metrics, apply only when able to perform, follow accepted briefs, disclose conflicts, submit original or properly licensed work, meet agreed deadlines, and clearly identify sponsored content as required.
Both parties must communicate professionally, protect confidential material, keep evidence relevant to a dispute, and use Castify's workflow in good faith. Ratings and reviews must reflect a genuine completed collaboration and may not be purchased, coerced, or manipulated.
4. Social-platform connections and API terms
TikTok, Meta/Facebook, Google/YouTube, and Instagram are independent third parties. Use of their accounts and data remains subject to their own terms and policies. By connecting or using features that incorporate YouTube API Services, you also agree to be bound by the YouTube Terms of Service; TikTok use remains subject to the current TikTok Terms and TikTok Developer Terms.
Castify requests only scopes it currently uses: TikTok user.info.basic, user.info.profile, and user.info.stats; Facebook pages_show_list and pages_read_engagement; and YouTube youtube.readonly. Before OAuth, Castify displays the scopes, data categories, purposes, retention, and deletion controls. A connection may fail when a required scope is withheld.
You authorize Castify to use provider data only for the functions described in the Privacy Policy. You must not use Castify or data received through it to scrape, build unauthorized databases, sell or transfer social data, identify anonymous people, infer sensitive traits, create prohibited YouTube-derived metrics, or reproduce a provider's core service.
You can disconnect at any time. Castify deletes credentials, asks the provider to revoke access, and deletes Authorized Data under the applicable timeline. Revoking or deleting Castify-held data does not delete an account or content held by a social platform; use that platform's controls to delete its content.
5. Campaigns, advertising disclosure, and content
A published campaign must accurately state the brand, objective, eligibility, requested platforms, deliverables, budget or pricing method, schedule, revision limits, content usage rights, and any exclusivity, paid-media, whitelisting, licensing, or buyout condition.
Creators and brands are jointly responsible for making sponsorship, gifted-product, affiliate, testimonial, and other material-connection disclosures clearly and prominently as required by Vietnamese law and the rules of the platform where content appears.
Content must not violate law, privacy, publicity rights, intellectual property, platform rules, consumer-protection duties, or third-party contracts. Do not submit malware, illegal goods, harassment, hate, sexual exploitation, dangerous deception, or content that impersonates another person or business.
Castify records workflow states and evidence but does not pre-approve every claim. A Castify approval state means the designated participant accepted that workflow step; it is not legal, medical, financial, advertising, or platform-policy clearance.
6. Ownership and usage rights
Each party keeps ownership of material it owned before the collaboration. Creators generally retain ownership of new content unless the accepted brief expressly grants a license or buyout after the stated conditions, including payment, are met.
The accepted brief must define permitted channels, territory, duration, organic or paid use, editing, attribution, sublicensing, exclusivity, and whitelisting where relevant. A party may not expand those rights by copying a public preview or downloading a file outside the agreed purpose.
You grant Castify a limited, non-exclusive license to host, transform for technical delivery, and display material only as needed to operate the service and the visibility settings you choose. You confirm that you have the rights needed to grant that license.
7. Pricing, payments, taxes, and disputes
Prices, platform charges, taxes, payment milestones, and refund terms must be visible before confirmation. Unless Castify expressly states that it holds funds in escrow, a payment record or VietQR instruction is workflow evidence and not a bank guarantee or escrow service.
Each party is responsible for accurate bank and billing information and for its own invoices, taxes, withholding, declarations, and statutory obligations. Castify may delay or restrict a transaction to investigate fraud, sanctions, identity, duplicate payment, or reconciliation issues.
Use the dispute workflow promptly and provide accurate evidence. Castify may facilitate communication and apply platform rules, but a platform decision does not prevent either party from exercising non-waivable legal rights.
8. Prohibited conduct
Do not bypass access controls, probe security, introduce malicious code, overload the service, reverse engineer protected components, call undocumented APIs, scrape Castify or social platforms, sell access, or use another person's credentials or OAuth grant.
Do not fabricate identities, businesses, metrics, applications, deliverables, payments, reviews, or evidence; manipulate rankings; spam; move a collaboration off-platform to evade an agreed fee; redistribute API data without rights; or misuse confidential or personal data.
Do not use social or Castify data for surveillance, discrimination, credit, employment, insurance, housing, or other high-impact decisions; combine it to infer sensitive traits; or build a personal-profile database outside the consented purpose. Report abuse to support@castify.io.vn.
9. Suspension, termination, and deletion
You may stop using Castify, disconnect social accounts, or request account deletion. Active collaborations may need to be completed, cancelled, or resolved before deletion can finish.
Castify may limit, suspend, or terminate access when reasonably necessary for security, fraud prevention, legal compliance, provider requirements, non-payment, material breach, or protection of users. When appropriate, we provide notice and an opportunity to respond.
Termination ends future access but does not erase accrued payment duties, accepted usage rights, confidentiality, dispute rights, or records that must lawfully be retained. OAuth credentials and Authorized Data are handled under the Privacy Policy and provider timelines.
10. Service availability and liability
Castify is provided on an as-available basis. We work to maintain a secure and reliable service but cannot guarantee uninterrupted operation, provider API availability, campaign outcomes, creator performance, brand solvency, audience authenticity, or third-party conduct.
To the extent allowed by applicable law, Castify is not liable for indirect, incidental, special, punitive, or consequential loss, lost profit, reputation, or data caused by another user, provider, external payment system, or event beyond reasonable control.
Nothing in these Terms excludes rights or liability that cannot lawfully be excluded, including liability for fraud or intentional misconduct. Any specific paid plan or separate written agreement may state additional service levels or liability terms.
11. Versions, governing rules, and contact
Castify may update these Terms to reflect product, provider, legal, or security changes. Each version has an effective date and hash. For a material change, signed-in users receive notice and must explicitly accept the new version; silence or continued browsing alone is not recorded as acceptance.
These Terms are governed by applicable Vietnamese law. The parties should first try in good faith to resolve a dispute through Castify support; any non-waivable right to bring a matter before a competent authority remains unaffected.
